Pitman Buck, Jr. is one of the true unsung luminaries in the tax education
movement. A long time researcher and among the most incisive of writers, Pitman
probably has more constitutionally trained neurons per cubic inch than all of
the
federal district judges in the entire country combined (Sorry, Pitman, that
really wasn't much of a compliment, but everyone gets the point ;-).

Confessions And The Income Tax System -- by Pitman Buck, Jr.

Supreme Court Justice Hugo Black declared in United States v. Kahriger, 345 U.S.
22 (1953) that, 'The United States has a system of taxation by confession.'
(Italics added.) In Flora v. United States, 362 U.S. 145 (1960), the Supreme
Court stated: 'Our tax system is based upon voluntary assessment and payment,
not
distraint.' (Italics added) There are two kinds of confessions, voluntary and
involuntary, so one may ask, to which kind of confession was Justice Black in
Kahriger referring.

Black's Law Dictionary, 6th ed., defines the two kinds of confessions as
follows:

'Confession. A voluntary statement made by a person charged with the commission
of a crime or misdemeanor, communicated to another person, wherein he
acknowledges himself to be guilty of the offense charged, and discloses the
circumstances of the act or the share and participation which he had in it. See
also 18 U.S.C.A. section 3501.' (Italics added.)

'Involuntary confession. Confession is 'involuntary' if it is not the product of
an essentially free and unrestrained choice of its maker or where maker's will
is
overborne at the time of the confession. [Citation omitted.] Term refers to
confessions that are extracted by any threats of violence, or obtained by direct
or implied promises, or by exertion of improper influence. [Citation omitted.]'

Moreover, only one kind of confession is admissible in a court of law:

The Supreme Court has laid down some guidelines to distinguish a voluntary
confession from an involuntary confession. In Rogers v Richmond, 365 U.S. 534
(1961), the court stated, 'The motive of a person in confessing is of no
importance provided the particular confession does not result from threats,
fear,
or promises made by persons in actual or seeming authority.' Over the years, the
IRS has mailed CP-518s to hundreds of thousands of people. Among other things, a
CP-518 threatens its recipient with criminal proceedings, a fine and
imprisonment
if s/he does not file a Form 1040 tax return. A form filed under such threats is
not a valid return.

In Townsend v. Sain, 372 U.S. 293 U.S. 293 (1963), at page 307, the Supreme
Court
stated: 'If an individual's 'will was overborne' or if his confession was not
'the product of a rational intellect and a free will, ' his confession is
inadmissible because [it was] coerced.' Every year, millions of people rush to
make and file Form 1040 'tax confessions' by midnight of April 15th. Everyone
knows this annual ritual is not done voluntarily but out of fear, intimidation,
threats and coercion; the courts know this too but accept these bogus
confessions
as valid, knowing that statements signed under coercion do not subject their
affiants to the penalties of perjury.

Confessions, admissibility of. Subsections (d) and (e) of Title 18 U.S.C.A. 3501
read: '(d) Nothing contained in this section shall bar the admission of any
confession made or given voluntarily by any person to any other person without
interrogation by anyone, or at any time the person who made or gave such
confession was not under arrest or other detention. (e) As used in this section,
'confession' means any confession of guilt of any criminal offense or any
self-incriminating statement made or given orally or in writing.' (Italics
added.) I have quoted Subsections (d) and (e) of the U.S. Code to inform the
reader that the legal definition of 'confession' is not restricted or applied
solely to persons already 'charged with the commission of a crime or
misdemeanor.'

It should be obvious to all but the most obtuse or predisposed mind that a
statement or completed Form 1040 whose jurat was signed under coercion but
purports it was signed under (subject to) the penalties of perjury is a
statement
or completed Form 1040 verified by a lie! A valid Form 1040 tax return, if one
actually exists, is an affidavit. By legal definition, confessions and
affidavits
are voluntary documents, i.e., documents that were made of one's own free will.
It follows, therefore, that an individual may not be lawfully required,
compelled
or otherwise coerced to confess - on an IRS Form 1040 or any other document -
that s/he owes taxes.

Just because my blog is not updated dont think I am not pursuing freedom. On the contrary, it feels good to learn. I was listening to a taped talk radio program about taxes. Gordon Phillips was being interviewed by some guy named Jack Stockwell. A caller reffered to this US Supreme Court case as reason the IRS is not allowed to seize bank accounts without a judgement from the court. This of course they never do. They just try to bluff and take what they can. The caller named Ed from Salt Lake City UT, said that the IRS seized the bank account of his friend but gave back the money after this case was brought up.

I highly recomend the tape. They even have a tape for Doug about surviving incarceration :)

So I found the SCOTUS case in question and am now studying it. I really could get more research done if I had different priorities. As they stand now

---Ok, continuing my story from Tuesday.

That was a great night. My cell phone was ringing all night from people saying that they saw me on TV. There was such an expectancy that we would win. I and many of my friends were praying that GW would win. What would happen to our country if Al Gore won? We were praying that our country would return to God. With George Bush I knew that he would seek wisdom from God. Al Gore stood in defiance of God with his stands on abortion. I knew that if this country elected Al Gore, we would be in serious trouble. GW would appoint pro-life judges to the Supreme Court. One day Roe V Wade will be overturned.

As I watched and listened the results came in and FL turned back to Bush, Gore conceded. Our congress woman, Jennifer Dunn came up and made these declarations about the Republican agenda. Things like tax cuts, eliminating the death tax. I was almost in tears. The principle of passing on a inheritance is something that I have a great passion for. I don’t have a lot of money and my parents are not wealthy. My stand was based on what is right. It is wrong to take away property from someone. So I went home after the speeches. Once I got home I found out that Al Gore had taken it back. As the facts came to the surface we found that it was to close to call. Al Gore was trying to steal the election through the courts. A will have to go into detail another time on that.

What I have learned since July of this year it that my understanding of the law was wrong. So now I am becoming educated. I want to follow the law. I will not misapply the law.

Doug asks me how I can choose to continue paying income taxes knowing that I am not required to by law? As I understand the law at this time, submitting a W4 to my employer that said EXEMPT would be not correct. But if I did my employer would comply and not withhold Federal Income Tax. But my employer would still withhold Social Security and Medicare tax, which for me is still more than I pay in Income Tax.

So what will I do? There must be a better way and that is what I am finding out about.

I have great friends. True friends challenge you. Make you back up what you say with fact and reason.

So naturally they start to say, "What do you mean not pay taxes?" And here I am, needing to put my money where my mouth is. I sent him to a few websites but he was not impressed. He said "Chris, you're to much of a patriot to be anti-taxes and against your country." So how do I respond to that?

I grew up with a love of country. Reagan was elected while I was in the first grade. In fourth grade our class had a mock campaign and election. I really wanted to be involved so I was the campaign manager for the Democrats even though I would vote for Reagan. I even went to the evil dems HQ of Skagit county to pick up some Mondale/ Forarow signs.

Well Reagan swept the election, both in my class and in the country. Looking back I have always been a conservative. I used to watch Point Counterpoint on KIRO News in the 80s and wonder where that other guy got his ideas. Why couldn’t he understand the truth of John Carlson's argument? It just made sense.

I loved politics. I always wanted to work as a teenager in Olympia as a page.

So all this to say, I love George W Bush. I didn’t like him when he was first running. But once he became the nominee, and the more he was attacked by the left, the more I saw his character as a man.

I was at the Republican shin dig in Bellevue on election night. That was fun. I held up KVI signs behind Kirby Wilber for his TV interviews.

Today at lunch I heard a great shootout between Sean Hanity and Governor James E. Mcgreevey from NJ. Sean kicked his butt and would not let him get away with saying that the Courts are there to do what is best for the people. Sean's point was that the Courts are there to interpret the law.

I agree with sean.

Some random thoughts,
perspective, government as our parent? No. Flow of authority, comes from God, given to men, men can form a body politic. Our founders formed a republic after declaring and fighting for independence from the British Empire. The law of the land is the Constitution of the United States.

So the flow of authority comes from our constitution, so like a child that steps outside his boundries, we must learn to say no. The government is not our parent, its only authority is what we give it. I choose to not let this child run over me. I refuse to give a tyrant authority. Do you give a bum on the street $1000? Why not? That is the same reason you dont give authority to a tyrant.

What is wealth? Basicly our money is just an illussion. But how do we play the game? Once you understand how our economy works you can see that the rules can be bent, like in the Matrix. Not like defying gravity, but defying the illigitement government.

Well to an educational meeting last night. Glad my wife didnt go. She would have thought these guys were weird, I thought they were wierd. But I am sure they would take that as a compliment :) I got a look at another side of the Patriot movement. An idea that we can discharge debt on the principle that there is already a bond that we can access. What I dont like about this idea is that it can apeal to a sese of greed. Getting something that you do not work for. At this point I am not interested in that. But it was good to get another perspective.

Does knowledge equal power? With the internet we have the rapid flow of information, on anything. Asset protection that I have been learning about from FFA has to do with seperation of assets from an individual.

Income streams must be hidden from the IRS so as not to be assessed as taxable income. Doug brings up one way of keeping money private, a prepaid MasterCard. That is one way of holding on to and withdrawing money away from the eyes of unwanted snoops. But if I have $10,000 I wouldnt want it to just sit waiting to get spent.

Well I am going home for the night. I need internet at home.

Having a great time reading 1984. I am so glad that we dont live in a world like that. But it could happen. I am wondering who I am writing this journal to, I believe it is to my children. In America we still have the right to raise our children as we see fit. There is of course pressure from the government and others to raise our children by their standards.

How are men equal? God has created us equal. As we grow up and develop, by the choices of our parents, by our own choices, equality is impossible. We are each equal in our abilty to make choices. But choices have different outcomes for different people depending on who or where you are.

Doug has not been shy about his circumstace in life. He has made a choice to work as an employee and claim Exempt on his W4. He also has made the choice to not file a 1040 tax return. Doug is learning how to deal with the IRS as they tell him that he owes $76,000.

I am also learning how to deal with the IRS, but I havent taken any action yet. At least not like Doug. I am learning what steps I need to take to be successful.

Doug states that if a IRS agent shows up at his door to take his car he will just ignore him, pick up his keys and go for a nice drive. I have question for Doug. What if they go to your bank on payday and drain your account? Or what if the go to your employer and garnish your paycheck? These are the questions that I ask on my search for how to move forward.
